Fentanyl has its own thresholds. Possessing 1 gram or less of fentanyl, carfentanil, or a benzimidazole opiate compound is a level 1 drug misdemeanor on a first offense. Possessing more than 1 gram of those substances is a level 4 drug felony. Colorado law also provides for a level 2 drug felony when a substance is more than 60 percent fentanyl, carfentanil, or a benzimidazole opiate by composition, though this enhanced penalty applies only once state crime labs certify they can reliably measure that composition. Marijuana possession is governed by separate Colorado statutes and doesn’t fall under this framework.
