Under CRS 18-18-405, Colorado makes it unlawful to knowingly manufacture a controlled substance or to possess one with intent to do so. The statute reaches further than many people expect. It also covers inducing or conspiring with others to manufacture, and possessing chemicals, supplies, or equipment with intent to manufacture, even if production never began.

Colorado’s definition of manufacturing is broad. It includes producing, preparing, propagating, compounding, converting, or processing a controlled substance, as well as packaging, repackaging, labeling, or relabeling its container. The statute does carve out preparation or compounding performed by a licensed practitioner in the course of professional practice, but that exemption is narrow and fact-specific.

Colorado Drug Manufacturing Penalties by Felony Level

Manufacturing charges in Colorado are classified as drug felonies or drug misdemeanors depending on the substance and circumstances. Potential sentences can vary significantly by level:

• Level 1 drug felony: 8 to 32 years in prison, a mandatory minimum of 8 years, at least 3 years of mandatory parole, and fines from $5,000 to $1 million
• Level 2 drug felony: 4 to 16 years in prison and fines from $3,000 to $750,000
• Level 3 drug felony: 2 to 6 years in prison and fines from $2,000 to $500,000
• Level 4 drug felony: 6 months to 2 years in prison and fines from $1,000 to $100,000
• Level 1 drug misdemeanor: 6 to 18 months in jail and fines from $500 to $5,000

These ranges represent what a conviction can carry. The actual sentence depends on the controlled substance schedule, the quantity involved, prior criminal history, and how the case resolves.
